SECTION A: ALL STUDENTS

  1. Liability Waiver and Release

    1. I understand and acknowledge that my child will engage in activities that may result in injury. My child has been cleared by his or her physician to take a class, or I am choosing to allow my child to participate without their recommendation. Therefore, I hereby release, waive and discharge Pure Dance Works, LLC, its owners, and teachers, including any members, employees, agents, representatives, and assigns of and from any and every claim, demand, action, or right of action of whatever kind or nature, either in law or equity arising from or by reason of any bodily injury, personal injuries known or unknown, personal illness or property damage resulting from or to result from participating in class or any other activities at the studio, or other off-site locations.

    2. I voluntarily assume full responsibility for any personal injury, illness, or other loss that may be sustained as a result of the participation in activities at Pure Dance Works for my children, myself, my family, and my guests. It is my express intent that this Waiver and Release shall bind me, the members of my family, my spouse, heirs, assigns, and personal representatives. I understand that this waiver applies to other locations when classes or events are held off-site.

  2. Placement The faculty at Pure Dance Works will ensure that students are placed in classes appropriate for their developmental and ability level. Students enrolled in a class beyond their ability will be transferred to an appropriate class where they can develop the skills necessary for proper progression.

  3. Dancer Manners Students must follow all studio rules as outlined in the Dancer Manners document. Students will not be allowed to dance without proper dress code or if they arrive after warm-ups. Students who do not choose to behave respectfully may be removed from class and may be dismissed from the studio.

  4. Inform the Studio of Conditions That May Affect Your Child so we can work together to ensure their safety and help them succeed. This includes but is not limited to allergies, custody rulings, and medical, physical, social, emotional, or cognitive conditions or disabilities.

  5. Photo/Video/Audio Agreement and Release

    1. I agree to allow photos and/or videos of my children, myself, and my family to be used in promotional material of any kind for Pure Dance Works, LLC, during and after my child’s enrollment period.

    2. I understand that video and audio security footage may be recorded in the building anytime. Therefore, I understand that conversations and actions in the studios should not be considered private.

  6. Social Media Policies

    1. I understand that the studio cannot police and is not responsible for photos, videos, or other content that others (parents, students, etc.) may post online of my children or myself while attending a class or event at or hosted by Pure Dance Works.

    2. I understand that I am responsible for what I post online and am expected to use common courtesy and good judgment when posting photos, videos, or comments relating to students and staff at the studio. This includes avoiding slanderous or misleading statements and not posting students’ private information, such as names and locations.

    3. Choreography is privately owned intellectual property and may not be posted online without the CEO's written permission.

  7. Studio Correspondence Email is the primary communication between the studio and parents. One contact on each account is designated as the “Primary” contact, and certain emails, such as receipts, missed payments, and confirmation emails, will automatically go only to this address. An active email address that is opted in to email communications must be provided for this contact. The primary contact is responsible for noting important dates and events communicated via email. Account holders and contacts are encouraged, but not required, to opt-in to text updates regarding urgent studio information.

  8. Authorization To Charge My Card I authorize Pure Dance Works, LLC, to charge my card(s) on file for any service rendered, product provided, or late fees incurred.

  9. Returned Check Fee A $20 service charge plus any other applicable bank charges will apply if the bank returns a check.

  10. 21-Day Missed Payment Process If a payment is missed for any reason, the 21-Day Missed Payment Process will be utilized starting from the day of the missed payment.  This includes a failed credit or debit card charge, a returned check, or failure to make payment at the time of purchase or service. An email will notify the account holder of the missed payment. When a credit or debit card transaction fails, no fees will be charged by your bank or credit card company. Consequences for a past-due balance are allocated over a 21-Day Missed Payment Process starting from the date the payment was due as follows:

Day 1
The account holder is notified of the missed payment. Ensuring that the payment can be processed before Day 7 will avoid late fees and keep the student's enrollment status active
Day 7
If a payment is outstanding on the 7th day, the account will incur a $15 late fee. The balance on the account must be paid in full within seven days (by Day 14) to keep the student’s enrollment active.

Day 14
If a balance remains on the account, the account will incur a late fee equal to 10% of the total balance due, and the student's enrollment status will be paused. The student may only attend class once the account is paid in full.
The student's account will be reactivated if the payment is made in full within seven days (by Day 21).

Day 21
If a balance remains on the account, the student's enrollment will be withdrawn, and the account payment plan will be suspended.  A new student may claim the withdrawn student's spot in the class.
Reinstating Enrollment After Day 21
If the balance is paid in full and the student’s spot remains open, the student’s enrollment status will be reinstated immediately upon receipt, and the payment plan will resume starting from Day 21.
Make-Up Classes For Paused Enrollments
If a student misses class due to a paused enrollment, the parent may schedule make-up classes by following the regular make-up class policy once the balance has been paid in full.

SECTION B: POLICIES THAT APPLY TO ALL PERPETUALLY ENROLLED STUDENTS IN

DEWDROP, SPARKLE, RIPPLE, GRAD COLLAB & INTEGRATIVE

  1. Enrollment Fee A non-refundable enrollment fee is required to secure a spot in a class for a new student or a previous student who is re-enrolling after more than one year.

  2. Perpetual Enrollment Students are perpetually enrolled. Enrollment automatically rolls over from one season to the next. Super Simple Monthly Fees will continue to be charged until the student withdraws, graduates from high school, or is dismissed.

  3. Priority Placement Current students are afforded priority placement in the next season, usually before enrollment opens to the public. Parents must confirm their intention to continue or withdraw during Confirmation Windows (See Sections C & D for details that apply by program and season).

  4. Annual Placement Fee A non-refundable Annual Placement Fee is charged for each continuing student once a year. A student must officially withdraw by the due date to avoid the Annual Placement Fee. See Sections C & D for due dates by program.

  5. Super Simple Monthly Fees combine class-related expenses that apply equally to all students based on age and enrollment date and package them into consistent budgeted payments that parents can depend on from month to month. Inclusions vary by program and enrollment date; please see Sections C & D for more details.

  6. Payment Method All accounts are stored securely online and are required to have at least one valid form of payment saved on file for monthly payments.

    1. All Super Simple Monthly Fees will be auto-charged to the primary card on the account. If more than one card is on file, any card may be charged if the primary fails.

    2. Account holders may pay online for Super Simple Monthly Fees up to one month in advance via the Make Payment option on their online account if desired, but this is not necessary.

    3. Super Simple Monthly Fees may not be paid by cash or check at the front desk or by mail.

  7. Payment Dates Generally, Super Simple Monthly Fees are charged on the 1st of each month year-round. Super Simple Monthly Fees may be charged on the prior business day when the payment date falls on a weekend or holiday. (See Section C for two date exceptions that apply to Dewdrop.)

  8. Refund Policy All fees are non-refundable with two exceptions:

    1. Schedule Adjustment If the studio alters the class schedule so that the family schedule no longer allows the student to attend class, a pro-rated refund for tuition based on the date of change will be issued.

    2. 100% Happiness 48-Hour Money-Back Guarantee After your child attends their first class, if you are unsatisfied and wish to cancel, contact us within 48 hours of the class ending time to request a refund for your first month’s fees. We’ll send you a withdrawal form via email. Once you’ve completed the form and returned all included uniform apparel,  we will cancel your child’s enrollment and issue a full refund for your first month’s fees. Any unreturned uniform apparel will be deducted from the refund. Non-uniform materials received are yours to keep. Shoes are not included in the Super Simple Monthly Fees but may be returned for a refund in this case only. The Enrollment Fee is non-refundable under any circumstances.

  9. Optional, Complementary Make-Up Classes

    1. Definition Make-up classes consist of registering to attend a class similar to the student’s regular class.

    2. Nine complementary make-up classes are included annually Students who miss class for any personal reason (illness, vacation, school functions, etc.) may schedule an optional, complimentary make-up class up to 9 times per studio year from August - July. Additional make-up classes beyond 9 may be scheduled at the current make-up class rate.

    3. Studio Cancelled Classes If the studio closes due to weather, a holiday, or a studio event, students in the affected classes will be allotted one additional complimentary make-up class per closure. Christmas Break and Spring Break are not counted as part of any class season; make-up classes do not apply during these holiday breaks.

    4. Schedule In Advance Make-up classes must be scheduled in advance, either on the “Schedule A Make-Up” page of the website or by contacting the studio office.

    5. Limited Availability Make-up class spots are available on a first-come, first-served basis and are not guaranteed.

    6. Make-Up Class Expiration

      1. Complimentary make-up classes expire one month following the end of the season in which the class is held.

      2. Make-up classes are only open to currently enrolled students; therefore, taking a make-up class in a new season requires continued enrollment into the new season.

  10. Prolonged Travel, Injury, or Illness

    1. Holding Your Spot If a  student will miss a series of four or more consecutive classes due to a prolonged trip, injury, illness, or other life events, we will hold the student’s spot in class as long as monthly payments continue during the student’s absence. When the student returns, they may take make-up classes, if available, equal to the number of classes they missed at no additional charge. These make-up classes count against the student’s nine free make-up classes annually.

    2. Pausing Monthly Fees If a student will have a prolonged absence of four or more consecutive classes for any reason but plans to return at a set date, you may pause your monthly payments by requesting and completing the “pause enrollment form.” No refunds will be made for payments made to date. The student’s spot in class is not guaranteed; the class could reach capacity before the student’s return. If the spot is still open when the student returns, we will reinstate the student’s enrollment. The student will not be eligible for free make-up classes for the period they were absent. If the student meets eligibility requirements for the upcoming performance, a catch-up fee will be assessed for the non-tuition portion of the monthly class fee. The catch-up fee will be charged when the student returns to class. If necessary, private make-up classes may be required for the student to perform at an additional fee.

  11. Withdrawals Parents may withdraw students from their current class anytime by requesting and completing the official digital withdrawal form.

    1. Early Withdrawal Fee | If you withdraw before the end date of the current season, an Early Withdrawal Fee may apply. This fee covers the cost of physical inclusions that have been received or ordered and cannot be returned to the manufacturer. The Early Withdrawal Fee amount will be calculated based on the withdrawal date and communicated via email. After completing the withdrawal form, the Early Withdrawal Fee will be charged to the card on file.

    2. Super Simple Monthly Fees Cease | Once the withdrawal form has been completed and the early withdrawal fee paid (if applicable), no further Super Simple Monthly Fees will be charged to the account.

    3. Enrollment End Date | Once the withdrawal form has been completed, the student will be unenrolled as of the last day of the current month. Students may continue to take class through the remainder of the month if desired.

SECTION C: DEWDROP

  1. Ages Dewdrop students are at least 18 months old and steady on their feet as of the first day of class. The maximum age is three years old.

  2. Participants Dewdrop students attend class with an adult. A max of two adults may attend per student. Siblings 6 months and younger may attend; older siblings or children may not attend.

  3. Seasons & Payment Dates Most Dewdrop classes run in 10-week seasons, with payments for each season charged in three equal installments. An exception is the four-week Holiday season (see below):

    1. Fall 10-Week Season begins the week after Labor Day | Payment dates: Sept 1, Oct 1, Nov 1

    2. Holiday 4-Week Season begins the week after Thanksgiving | Payment Date: Dec 1

    3. Winter 10-Week Season begins in January | Payment dates: Jan 1, Feb 1, Mar 1

    4. Spring 10-Week Season begins mid-March. Payment dates: | Mar 14*, Apr 1, May 1 (*The first spring payment date varies slightly by season; usually the Monday of the first week of Spring Dewdrop classes.)

    5. Summer 10-Week Season begins in June | Payment dates: June 1, July 1, Aug 1

  4. Late Enrollments  New Dewdrop students may enroll until Week 3 of each 10-week season. When enrolling after the first class of the season, Dewdrop students may take makeup class(es) to account for the missed class(es). Fees are not pro-rated; the first payment will be charged on or before the student’s first day of class.

  5. Inclusions The Dewdrop package includes one class uniform annually, tuition for weekly classes, a weekly email newsletter, and weekly coloring sheets. Students enrolled in 10-week Seasons receive a dance bag, movement prop, and 3-ring binder annually and guaranteed reservations in upcoming seasons

  6. Dewdrop is a non-performing program. Students do not perform on stage, and no performance package is associated with Dewdrop Super Simple Monthly Fees.

  7. Guaranteed Reservation Response Required

    1. Upon enrollment, we automatically reserve a spot for Dewdrop students in the same (or a similar) class time for the 10-week seasons through the next year or until the student is old enough to graduate from Dewdrop. Then we save them a place in a Sparkle 3 Ballet class.

    2. During week 5 of each season, parents are provided with a simple online form to confirm that they wish to hold the spot for their child in the upcoming season(s) or withdraw after the current season.

    3. Not responding does not equal withdrawing. Anyone not completing the confirmation form will maintain the child’s “enrolled” status, but a specific class reservation for the upcoming season(s) will no longer be guaranteed. The first non-refundable Super Simple Monthly Fee for the new season will be charged on the first payment date for the new season unless the student is officially withdrawn before the payment date.

    4. The non-refundable Annual Placement Fee is charged for Dewdrop students continuing into the Fall Season on the Monday of Summer Season Week 7 (early July). New students who started in the Summer Season will not be charged until the following year.

      2. The July 1 Super Simple Monthly Fee covers summer season classes.

  3. Catch-Up Fees | Enrolling after the first day of class:  When a student enrolls after the first class of the season, a catch-up fee will be due before the first class. The catch-up fee covers the cost of all inclusions not covered in the remaining Super Simple Monthly Fees for the season. The catch-up fee amount and payment date are based on the enrollment date and are communicated via email.

  4. Performances

    1. Performance Eligibility A public performance is produced by the studio at an off-site venue in December and June. All Sparkle, Ripple, Grad Collab, and Integrative students who meet the eligibility requirements based on enrollment date will participate in the performance. No refunds will be issued if a student does not perform. Student accounts must be paid in full to participate in dress rehearsals and performances.

    2. Late Enrollments

      1. Sparkle, Ripple, and Integrative students enrolled after the 1st week of the 40-week season that begins mid-August may not be eligible to perform in the December performance but will still participate fully in class.

      2. Sparkle, Ripple, and Integrative students enrolled after December 20 are not eligible to perform in the spring performance but will still participate fully in class.

    3. Program Ad or Fee

      1. All families with students participating in the Christmas Concert are asked to secure at least one business ad for the performance programs due in early November. Families who do not secure a business ad will be charged the current Program Fee the day after the ad's due date in November.

      2. Students who enroll after the cut-off to perform in the Christmas Concert will perform in the Spring Performance. The Program Fee is rolled into the catch-up fee charged to students who begin after the start of the season.

    4. Performance Package In addition to inclusions provided to enrolled students, a full or partial performance package is included for eligible students based on enrollment date.

      1. The Performance Package includes

        3. All required rehearsals and performances

      2. The Performance Package does not include:

        4. Performance tickets

        5. Photos

        6. Hair or makeup services

    5. Multiple Shows May Be Required

      1. Ripple and Grad Collab classes may be required to perform in multiple shows.

      2. Families With Multiple Enrollments Students in multiple classes and siblings in separate classes may perform in multiple shows.

    6. Casting Lead Roles Select students may be cast in a lead role in the performance. This may require additional rehearsals and performing in an additional show.

    7. Absences in November, December, April, & May Students who are absent or unable to fully participate in class for any reason more than once during November, December, April, or May may need to arrange a private catch-up lesson at the current private lesson rate, or they may need to be removed from the performance. This will be determined on a case-by-case basis, and the studio will make every effort to keep the student in the performance. Students who are removed from the performance will receive two tickets to the performance. No refunds will be issued.

    8. Rehearsals

      1. In-Studio Run-Through | Lead roles must attend the in-studio run-through. Other students with an unavoidable schedule conflict with the in-studio run-through must secure approval for their absence ahead of time or risk being removed from the performance.

      2. Dress Rehearsal | Failure to participate in the mandatory dress rehearsal at the theatre for any reason will cause a student to be removed from the performance with no refunds.

  5. Attendance Policy

    1. Tardiness A Ripple or Grad Collab student is marked “tardy” when they arrive after the warm-up section of the class for any reason.

      1. When a student arrives after the warm-up, they will learn by observing the class and taking notes rather than dancing for the day. This is for the dancer’s safety and out of respect for the teacher and classmates.

      2. When a student is tardy three or more times for the same class, he or she will observe the class and be counted absent for the day.

    2. Absences Absences for any reason totaling more than 15% of the season’s classes (6 or more absences during the 40-week school year season) may affect a student’s progress. This includes students with prolonged travel, injury or illness. Excessive absences may result in any or all of the following at the teacher’s and CEO’s joint discretion:

      1. Required private make-up lessons at an additional cost,

      2. Moving down one level during the current season,

      3. Remaining at the same level the following season, and/or

      4. Removal from the upcoming performance.

    3. Injury Students ages five and up who suffer an injury (such as a broken bone) and can attend class to observe must do so. Once healed, they may attend an appropriate make-up class (if available) at no cost equal to the number of classes they observed. Private catch-up lessons may be required at an additional cost.

  6. Make-Up Classes

    1. Cancel Absences When a student takes an appropriate make-up class, a prior absence will be removed from their record.

    2. Make-Up Classes Required For Excessive Absences

      1. If a student misses three consecutive classes, s/he may be required to take a complimentary make-up class, if available, for each consecutive class missed to continue in the class.

      2. If no make-up spots in an appropriate class are available or do not fit the student’s personal availability, a private catch-up lesson at the current private lesson rate may be required (see below).

  7. “Privates” | Refers to Private Catch-Up Lessons and Private Classes

    1. Private Catch-Up Lessons are for current students who are required to catch-up to their peers for any reason. The lessons may be private (1:1) or semi-private (shared with up to three students) when possible. The current private or semi-private instruction rate applies. Private catch-up lessons are scheduled based on time, teacher, studio, and student availability. Private catch-up lessons cancel absences in weekly group classes.

      1. Excessive Absences If a student has excessive absences (generally 4 or more per semester) that have caused him or her to fall behind in the class, the teacher may require private catch-up lessons at the current private lesson rate to continue in the class and/or perform in the upcoming performance. Students not completing required private catch-up lessons may forfeit their spot in the performance and related fees.

      2. Ripple 1 students who enroll after the 4th week of the season must take private catch-up lessons in conjunction with their weekly group class. The number of lessons needed will be determined based on the enrollment date and how quickly the student catches up with the class content.

      3. Beginning students ages 10+ who begin in Ripple 2 must take at least six private catch-up lessons in conjunction with their weekly group class.

    2. Private Classes are for anyone wanting to receive private instruction separate from weekly group class content for any reason. This may or may not be a student enrolled in weekly classes. Private classes are scheduled at the discretion of the CEO.

      1. All private class students must create an account with the studio via the website and keep at least one valid form of payment on file.

      2. Private lessons with a Pure Dance Works instructor may only be arranged through the office.

      3. All private classes initiated through Pure Dance Works will remain under contract with the studio as long as the teacher is employed by Pure Dance Works and for the duration of his or her non-compete agreement.

      4. Private classes do not participate in performances.

    3. Payments For Privates

      1. Fees cover tuition only.

      2. Payments are made directly to the studio before the private occurs via an automatic charge to a card on file.

    4. Private Cancellations (Absences) | Refunds for missed privates will not be issued. In some circumstances, however, a credit will be applied. The studio will make every effort to reschedule missed privates based on time, teacher, and space availability.

      1. Uncommunicated Absence

        1. No credit will be issued if a student misses a private without communication. If the private is rescheduled, an additional fee will apply.

      2. Communicated Absence

        1. Less than 24 hours | The first time an absence is communicated less than 24 hours in advance, a credit will be applied to the student’s account for ½ the private fee. Future cancellations less than 24 hours in advance during the same season will not result in a credit, and an additional fee will apply for a rescheduled private lesson.

        2. More than 24 hours | The private fee will be credited to the student's account if an absence is communicated at least 24 hours in advance.

      3. Multiple Absences

        1. Required Private Catch-Up Lessons | Required private catch-up lessons that are missed must be rescheduled and will incur additional fees. Any credit on the account may be used toward the rescheduled lesson. Failure to complete required private catch-up lessons may result in the student being moved down one level during the current season, not moving up to the expected level the following season, and/or being removed from the upcoming performance at the teacher and/or director’s discretion.

        2. Private Classes | Missing more than 3 times per quarter may result in  cancellation of the private class.

  8. Priority Placement In Upcoming Seasons

    1. School Year Season  -> Summer Season | In February, current students get Priority Selection of summer class times before we open enrollment to the public on March 1.

    2. School Year Season -> School Year Season | In May, current students receive a Guaranteed Reservation in a specific class for the following school year before we open to the public.

    3. Summer Season -> School Year Season | Those who first enroll during the summer receive a Simple Registration form to quickly and easily select their child’s class based on current availability for the school year.

    4. Annual Placement Fee | The non-refundable Annual Placement Fee holds the student’s spot in the upcoming season. It is charged for all students not withdrawn for the following season on May 15.

    5. A Response During The Confirmation Window Is Required

      1. Parents must complete the simple form provided via email during each confirmation window. Depending on the season, there may be choices to select a class, confirm a class, request a class change, pause, or withdraw after the conclusion of the current season.

      2. Not responding does not equal withdrawing. Super Simple Monthly Fees will continue until a student is officially withdrawn, and the non-refundable Annual Placement Fee will be charged on May 15.

SECTION E: SPLASH CLASS POLICIES

FOR ONE-TIME CLASSES OR CAMPS

  1. SPLASH CLASS REGISTRATION POLICIES Splash classes are any one-time class or camps separate from the seasonal weekly Dewdrop, Sparkle, Ripple, or Integrative Programs. Generally, they are one-day or one-week opportunities and do not continue perpetually.

    1. Payments Students only pay the stated Splash Class fee. If a deposit is due at the time of registration to hold the student’s spot, the balance due will be charged to a card on file on the first of the month in which the class will be held. If registering after the 1st, the full amount of the class is due at the time of registration.

    2. Cancellations If you need to cancel your Splash Class registration 8 days or more before the start date, you may contact the office for a full refund, including your deposit amount and any additional payments made to date. Cancellations for any reason for Splash classes made 7 days or less from the class start date will not be refunded but will result in a 75% tuition credit that may be used towards future classes.

    3. Enrollment There is no new student enrollment fee for a Splash Class, and new students who register for Splash Classes are not perpetually enrolled at Pure Dance Works if no further classes are chosen. If a Splash Class student's parent subsequently elects to place the child into an ongoing class. In that case, the student becomes an enrolled student, and all policies pertaining to enrolled students in this agreement shall apply.

    4. Inclusions Splash class fees include tuition only.

SECTION F: PERPETUAL AGREEMENT & CONCLUSION

  1. PERPETUAL AGREEMENT TO TERMS & CONDITIONS Your agreement to this document is perpetual as long as your child is registered for any class or is an enrolled student at Pure Dance Works. Enrollment is perpetual until the student completes their senior year of high school, is withdrawn by the parent or legal guardian, or is dismissed by Pure Dance Works. This agreement remains in effect for all future classes, regardless of the registration method. To cancel your agreement to this document and all future updated versions, you must submit an official withdrawal form for all students on your account to remove them from all classes at Pure Dance Works.

    1. I understand that Pure Dance Works, LLC may change these policies at any time without notice. Any changes will be emailed to the primary contact on an enrolled student’s account. The current version can always be accessed in the private Parent Portal portion of the website.

    2. I expressly agree that this Waiver and Release, as well as the other Terms and Conditions contained herein, are intended to be as broad and inclusive as permitted by the laws of the State of Indiana and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding the stricken provision, continue in full force and effect.

    3. I understand that by enrolling in any ongoing class, I am perpetually committed to this Enrollment Agreement until my child(ren) graduates, is withdrawn, or is dismissed by Pure Dance Works.
