Terms and Conditions of Enrollment
Liability Waiver and Release
I understand and acknowledge that my child will be engaging in activities that may result in injury. My child has been cleared by his or her personal physician to take dance class or I am choosing without their recommendation to allow my child to participate. Therefore, I hereby release, waive and discharge Pure Dance Works, LLC, its owners and teachers, including any members, employees, agents, representatives and assigns of and from any and every claim, demand, action or right of action of whatever kind or nature, either in law or equity arising from or by reason of any bodily injury, personal injuries known or unknown, personal illness or property damage resulting or to result from participating in class or any other activities at the studio, or other off-site locations.
I voluntarily assume full responsibility for any personal injury, illness, or other loss that may be sustained as a result of the participation in activities at Pure Dance Works. It is my express intent that this Waiver and Release shall bind me, the members of my family, spouse, heirs, assigns and personal representatives. I understand that when classes or events are held off site, this waiver applies to other locations as well.
Placement The Director, in conjunction with the teachers at Pure Dance Works, will place my child in the appropriate class for his/her age and/or ability.
Studio Rules Students must follow all studio rules as outlined in the Manners for Dancers document. Students must adhere to class dress code requirements, and will not be admitted to class without proper dress code. Students who do not follow studio regulations may be removed from class.
I Will Inform the Studio of Conditions That May Affect Myself or My Child in Class I agree to inform the studio in the Comments field of my online registration form of any medical, social, emotional or other condition affecting myself or my child that may relate to participation in class. I will also list any known allergies as well as any custody issues.
In the event that a student misses a group class for any reason (illness, vacation, studio cancelled class), an optional make-up class may be scheduled at no additional charge.
Make-up classes must be scheduled online or through the office.
The optional make-up policy does not apply to summer classes.
Photo/Video/Audio Agreement and Release
I agree to allow photos and/or videos of myself or my child to be used in promotional material for Pure Dance Works, LLC.
I understand that security footage (video and audio) may be recorded in the building at anytime, and therefore understand that conversations and actions in the studios should not be considered private.
Social Media Policies
I understand that the studio cannot police and is not responsible for photos, videos, or other content that other parents, students, etc. may post of myself or my child(ren) online while attending a class or event.
I understand that I am responsible for what I post online, and am expected to use common courtesy and good judgement when posting photos, videos or comments of other students and staff at the studio. This includes avoiding slanderous or misleading comments, as well as taking care not to post other students’ private information such as names and locations.
Choreography is privately owned material and may not be posted in it's entirety online without written permission from the studio's director.
Studio Correspondence I agree to be responsible for reading studio correspondence and respecting deadlines when applicable. I understand that email is the primary form of communication between the studio and parents, and I agree to read all emails in a timely manner, and to keep a working email address on my account.
Returned Check Fee I agree to pay a $20 service charge plus any other applicable fees charged by the bank if my bank returns my check.
Private lessons may be arranged through the office with a Pure Dance Works teacher. All private students must create an account with the studio and register for private lessons via the website. One time lessons may be paid at the front desk. Ongoing lessons lasting 4 or more consecutive weeks will be automatically charged to a card securely saved in the student’s account.Private lesson students do not participate in the annual performance. All private lessons initiated through Pure Dance Works remain under contract with the studio, and payments must be made directly to the studio only.
SHORT TERM CLASSES
A Short Term Class is any class that does not meet for the full 36 weeks from late August to mid-May.
Registration Fees Short Term class tuition must be paid in full at the time of registration in order to secure a spot in the class. Only tuition is included in short term class fees. Any required apparel or other expenses are additional and to be paid at the time of the separate transaction. If you need to cancel your registration more than 8 days prior to the start date, you may contact the office for a refund. Cancellations for any type of short term class made less than 7 days from the class start date will result in a 75% tuition credit that may used towards future classes.
Dress Code Short Term classes have a more relaxed dress code than full-term classes; class specific uniform colors and styles do not apply to short term classes.
Please see the Dancewear page of the website for details. This relaxed dress code must be followed in order for students to participate in class.
Performance There is no formal performance for short term classes. Instead, parents will be invited into the last class of the session for an informal presentation of what students have learned. Adult classes and Kindermusik classes do not have formal or informal performances.
Prolonged Travel or Injury/Illness
Students who must travel for an extended period of time may not have tuition frozen or credited during a short term class.
Students who become ill or injured and have to miss three (3) or more consecutive short term classe may request a tuition credit for a future short term class. A doctor’s note indicating that the student is unable to participate in class must accompany any requests for a tuition credit.
Perpetual Agreement to Terms & Conditions New students who enroll in any short term class may choose to enroll in future classes either by notifying the office or by registering online. These Terms and Conditions remain in effect for all future classes, regardless of enrollment method, unless I submit a written, signed and dated notice to Pure Dance Works that I no longer agree to the Terms & Conditions.
FULL TERM CLASSES
Full Term Classes meet weekly and run during the school year (Late August-Late May).
All-Inclusive Monthly Fees
All-inclusive pricing combines typical class-related fees and packages them into consistent budgeted payments that parents can depend on for the full term. The all-inclusive price package includes the annual registration fee, tuition, a class leotard or studio t-shirt (depending on class dress code), performance & rehearsal fees, performance costume, and a video file of the performance.
LUMP SUM PAYMENTS The all-inclusive fees for a full term class may be paid in one lump sum with any method of payment at a 5% discount by the first day of the term. Lump sum payments may be made after the start of the term, but no discount will apply. In the event that a student who has paid in full withdraws prior to the final May 1 payment date, a refund will be issued based on the number of FULL months remaining in the term, less the discounted amount, if applicable.
TEN (10) MONTHLY INSTALLMENTS The first payment is due at the time of registration and secures a student’s spot in class. The remaining nine (9) payments will be auto-drafted from a card on file on the first (1st) of every month, September - May, from a debit or credit card securely saved in the student’s account. All accounts are required to have a valid form of payment saved to their secure payment profile. Monthly payments may not be paid at the front desk.
Authorization To Charge My Card In order to utilize installment payments, I agree to create and save a payment profile with a debit or credit card in my secure Pure Dance Works account. I authorize Pure Dance Works, LLC, to charge my card(s) on file for my family's nine (9) installment payments September 1 - May 1. In addition, I understand that my student may not participate in the performance unless all fees on my account are paid in full one week prior to the performance. I therefore authorize Pure Dance Works, LLC, to charge my card(s) on file for any outstanding balance one week prior to my child’s performance date, or last day of class if not performing in the recital.
All monthly payments are non-refundable once they have been paid with the single exception of a student who pre-registers prior to publication of the class schedule who cannot be placed in a class that fits the family’s schedule.
Payments unable to be collected by the 6th of the month will incur a $10 late fee. Payments unable to be collected by the 10th of the month will be charged an additional late fee equal to 10% of the total balance due.
If a payment transaction fails, an automated email will notify account holders that their card was unable to be charged, but no fees will be charged by the bank or credit card company. Account holders should log in to their Pure Dance Works account and update their payment profile with a valid credit or debit card by the 6th of the month to avoid the late fees.
Late Enrollments Students who register after September 1 will pay their first month’s payment at the time of registration (the same as students who register prior to the beginning of the term). On the 1st of the following month auto-payments will begin for the remaining monthly payments.
In order to provide a hassle-free registration process from year to year, full term students are considered rolling members of Pure Dance Works with the privilege of being automatically enrolled in the following year’s classes before registration is open to the public.
In the spring, parents will be provided with a recommended class schedule for the fall based on the student’s progress. Parents may choose to accept the class(es) suggested, or there may be alternative classes to choose from based on the student’s interests and/or the family’s schedule.
On August 1 of each year, the card on file will be charged the first of the ten (10) monthly payments for the upcoming school year, and subsequent monthly payments will be charged on the first (1st) of each month through the following May.
There will be no monthly payments in June or July. Summer classes are optional but highly recommended for continued progress, and will be offered on an a la carte basis.
If a student wishes to drop out for the following term, a parent simply needs to sign an official withdrawal form prior to August 1 (see “Withdrawals,” below).
Parents may withdraw students from classes at any time by signing an official withdrawal form. Withdrawal forms are available at the studio or by request via email.
No refunds will be issued for any monthly payments made to date. Students may continue to take class through the remainder of the month if desired.
No further monthly payments will be charged to the card on file beyond the date of the signed withdrawal form.
Students who withdraw prior to the performance will be given two tickets to the performance in lieu of a costume.
In order to cancel a student’s continuous enrollment membership for the next full term and avoid a non-refundable charge to the card on August 1 for the first of 10 monthly payments, a parent must sign an official withdrawal form prior to August 1.
A public performance is produced by the studio at an off-site venue in late May. All students enrolled as of December 31 will participate in the performance. No refunds will be issued if a student does not perform. Student accounts must be paid in full through the final May 1 payment to participate in the performance.
Students enrolling on or after January 1 will not participate in the performance, but will still participate fully in class and will receive two tickets to the performance.
Two* performances are staged each year with most** classes participating in one show. (*Three shows may be deemed necessary depending on enrollment numbers. **Advanced classes may be required to perform in multiple shows.)
Every effort is made to place students in multiple classes and/or siblings in the same performance. This is not always possible, however, and therefore families with multiple enrollments may have children cast in multiple shows.
Students who meet certain criteria may be cast in a main role in the performance. Specific policies for main role cast members will be provided to eligible students and their parents.
All audience members must purchase a ticket for the performance; tickets go on sale on or around May 1. Guests coming to watch students who are cast in more than one show will receive a 50% discount on tickets to the show they purchase an equal or lesser number of tickets to.
Anytime a student misses class, an optional, complimentary make-up class may be scheduled.
If a student misses more than two consecutive classes, s/he may be required to take a complimentary make-up class for each class missed after two in order to continue in the class.
In the event that no appropriate make-up class exists, OR if a student has had excessive absences causing him or her to fall behind, students may be required to take private lessons at an additional expense.
Make-up classes must be scheduled in advance, either on the Schedule a Make-Up page of the website or by contacting the studio office.
Make-up classes are available on a first-come, first-serve basis and do not have guaranteed availability. Recommendations for choosing appropriate make up classes are listed on the Schedule a Make-Up page of the website.
Prolonged Travel, Injury or Illness
In the event that a full-term student will miss a series of classes either due to a prolonged trip or injury/illness, we will hold the student’s spot in class as long as the monthly payments may continue to be charged during the student’s absence. When the student returns, they may take make-up classes equal to the number of classes that they missed at no additional charge. The teacher or director may determine, however, that the student needs private catch-up lessons at an additional charge in order to be fully prepared for performance. Students refusing requested private catch-up classes may forfeit their spot in the performance and all performance related fees.
If a student with a prolonged absence chooses to withdraw from class in order to stop monthly payments, but plans to return later in the term, his or her spot is not guaranteed; the class could reach capacity before the student’s return. If the spot is still open, the student may re-enroll according to the “late enrollments” policy above, but will not be eligible for free make-up classes for the time period s/he was absent. Any private catch up lessons that needs to happen prior to the performance will be at an additional expense.
Students who are absent/injured/ill more than once during April and May may need to be removed from the performance. This will be determined on a case-by-case basis, and every effort will be made by the studio to keep the student in the performance. Students who are unable to perform will receive two tickets to the performance, and no refunds will be issued.
Conclusion (ALL CLASSES)
I understand that Pure Dance Works, LLC may change these policies at any time without notice. Any changes will be sent via email to all parents of enrolled students and be posted on the private “registered families only” portion of website.
I expressly agree that this Waiver and Release as well as the other Terms and Conditions contained herein are intended to be as broad and inclusive as permitted by the laws of the State of Indiana, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding the stricken provision, continue in full force and effect.
I understand that by registering for any class, I am perpetually agreeing to these Terms & Conditions until such time that I sign an official withdrawal form at the studio.
